Amicus Curiae Bebaskan Belenggu Suara Papua!

Abstrak

Setelah demonstrasi antirasisme merebak di berbagai kota pada Agustus dan September 2019, beberapa aktivis Papua pun ditangkap polisi dan didakwa oleh jaksa dengan tuduhan makar. Tuduhan tersebut didasarkan dengan alasan bahwa para aktivis tersebut membawa bendera Bintang Kejora dan menuntut akan adanya referendum. Pada Juni 2020, persidangan pun dilaksanakan di Pengadilan Negeri Balikpapan, Kalimantan Timur. Koalisi Penegak Hukum dan HAM Papua mengungkap sejumlah kejanggalan dalam sidang pembacaan tuntutan oleh jaksa penuntut umum (JPU) terhadap tujuh tahanan politik Papua dengan adanya penilaian bahwa tuntutan-tuntutan yang dibacakan ialah inkonsisten dan diduga terpengaruh oleh pihak lain seperti tuntutan tahanan selama 15–17 tahun. Oleh karena itu, BEM FH UI bersama dengan BEM UI mengajukan keterangan tertulis (Amicus Brief) ini dengan harapan dapat digunakan sebagai bahan pertimbangan. Amicus Curiae atau Sahabat Pengadilan merupakan pandangan atau informasi dari masyarakat sipil agar persidangan suatu perkara dapat berjalan objektif dan independen demi mewujudkan rasa keadilan.

Abstract

After anti-racism demonstrations broke out in various cities in August and September 2019, several Papuan activists were arrested by the police and charged by prosecutors with treason. The accusation was based on the reason that the activists carried the Morning Star flag and demanded a referendum. In June 2020, a trial was held at the Balikpapan District Court, East Kalimantan. The Papuan Law Enforcement and Human Rights Coalition revealed a number of irregularities in the reading of the charges by the public prosecutor (JPU) against seven Papuan political prisoners with the assessment that the charges read out were inconsistent and suspected of being influenced by other parties such as the demands of detainees for 15–17 years. Therefore, BEM FH UI and BEM UI submitted this written statement (Amicus Brief) in hopes that it could be used as material for consideration. Amicus Curiae or Friends of the Court are views or information from civil society so that the trial of a case can proceed objectively and independently in order to create a sense of justice.
