Online Single Submission: Mempercepat Perizinan atau Mempercepat Punahnya Lingkungan?

Abstrak

Online Single Submission (OSS) merupakan sistem perizinan berusaha terintegrasi secara elektronik yang ditujukan untuk mempermudah perizinan usaha. OSS secara resmi diluncurkan pada 9 Juli 2018 oleh Menteri Koordinator Perekonomian Indonesia, Darmin Nasution, melalui Peraturan Pemerintah Nomor 24 Tahun 2018 tentang Pelayanan Perizinan Berusaha Terintegrasi Secara Elektronik (PP 24/2018). Meski peluncuran OSS ditujukan untuk memperbaiki pelayanan publik dan mempermudah proses perizinan usaha, permasalahan muncul ketika ditemukan keambiguan terkait Izin Usaha Berbasis Komitmen yang seakan mengabaikan izin lingkungan. Maka dari itu, kajian ini akan membahas berbagai permasalahan yang timbul akibat OSS, di antaranya (1) terdapat ketidaksesuaian antara  PP 24/2018 dengan konstitusionalitas prinsip hukum lingkungan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945; (2) melanggar asas pencegahan dalam hukum lingkungan; (3) bertentangan dengan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup; dan (4) implikasi penerbitan izin sementara untuk izin lingkungan melalui Pengadilan Tata Usaha Negara yang menimbulkan kerancuan hukum.

Abstract

Online Single Submission (OSS) is an electronically integrated business licensing system built to facilitate business licensing. OSS was officially launched on July 9, 2018 by the Coordinating Minister for the Economy of Indonesia, Darmin Nasution, through Government Regulation Number 24 of 2018 concerning Electronically Integrated Business Licensing Services (PP 24/2018). Although the launch of OSS was aimed to improve public services and facilitate the business licensing process, problems arose when ambiguity was found regarding Commitment-Based Business Permits that seemed to ignore environmental permits. Therefore, this study will discuss various problems that arise as a result of OSS, including (1) contrary to the constitutionality of environmental law principles in the 1945 Constitution of the Republic of Indonesia; (2) violating the precautionary principle in environmental law; (3) contrary to Law Number 32 of 2009 concerning Environmental Protection and Management; and (4) the implication of issuing temporary permits for environmental permits through the State Administrative Court which creates legal confusion.
